fanzania- Terms and Conditions

fanzania is the flagship brand of YORKER GAMES LLP ("fanzania"). Through fanzania, along with its sub-pages, and the fanzania App, fanzania as used herein shall be construed as a collective reference to fanzania and the fanzania App.

  • Any person ("User") accessing fanzaniar the fanzania App ('fanzania platform') for participating in the various contests and games (including fantasy games), available on fanzania platform ("Contest(s)") ('fanzania Services') shall be bound by these Terms and Conditions, and allther rules, regulations and termsf use referred thereinr provided by fanzania in relation tany fanzania Services.
  • fanzania shall be entitled to modify these Terms and Conditions, rules, regulations and terms of use referred to herein or provided by fanzania in relation to any fanzania Services, at any time, by posting the same on fanzania. Use of fanzania constitutes the User's acceptance of such Terms and Conditions, rules, regulations and terms of use referred to herein or provided by fanzania in relation to any fanzania Services, as may be amended from time to time. fanzania may, at its sole discretion, also notify the User of any change or modification in these Terms and Conditions, rules, regulations and terms of use referred to herein or provided by fanzania, by way of sending an email to the User's registered email address or posting notifications in the User accounts. The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms and Conditions, rules, regulations and terms of use referred to herein or provided by fanzania. If such options are not exercised by the User within the time frame prescribed in the email or notification, the User will be deemed to have accepted the modified Terms and Conditions, rules, regulations and terms of use referred to herein or provided by fanzania
  • Certain fanzania Services being provided on fanzania may be subject to additional rules and regulations set down in that respect. To the extent that these Terms and Conditions are inconsistent with the additional conditions set down, the additional conditions shall prevail.
  • fanzania may, at its sole and absolute discretion:
    • Restrict, suspend, or terminate any User's access tallr any partf fanzaniar fanzania Platform Services;
    • Change, suspend, or discontinue allr any partf the fanzania Platform Services;
    • Reject, move, or remove any material that may be submitted by a User;
    • Mover remove any content that is availablen fanzania Platform
    • Deactivater delete a User's account and all related information and filesn the account;
    • Establish general practices and limits concerning use of fanzania Platform;
    • Reviser make additions tthe roster of players available for selection in a Contestn accountf revisions to the roster of players involved in the relevant Sports Event;
    • Assign its rights and liabilities to all User accounts hereunder to any entity (post intimation of such assignment shall be sent to all Users to their registered email ids)
  • In the event any User breaches, or fanzania reasonably believes that such User has breached these Terms and Conditions, or has illegally or improperly used fanzania or the fanzania Services, fanzania may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User's access to all or any part of fanzania Contests or the fanzania Platform, deactivate or delete the User's account and all related information on the account, delete any content posted by the User on fanzania and further, take technical and legal steps as it deems necessary.
  • If fanzania charges its Users a platform fee in respect of any fanzania Services, fanzania shall, without delay, repay such platform fee in the event of suspension or removal of the User's account or fanzania Services on account of any negligence or deficiency on the part of fanzania, but not if such suspension or removal is effected due to:
    • any breach or inadequate performance by the User of any of these Terms and Conditions. or
    • any circumstances beyond the reasonable control of fanzania.
  • Users consent to receiving communications such as announcements, administrative messages and advertisements from fanzania or any of its partners, licensors or associates.
  • fanzania includes a combination of content created by fanzania, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights ("Intellectual Property Rights") in all software underlying fanzania and the fanzania Platform and material published on fanzania, including (but not limited to) games, Contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and Flash animation, is owned by fanzania, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on fanzania either in whole or in part without express written license from fanzania.
  • Users may request permission to use any fanzania content by writing in to fanzania Helpdesk.
  • Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available on fanzania ("Users' Content"). Each User represents and warrants that he/she owns all Intellectual Property Rights in the User's Content and that no part of the User's Content infringes any third party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on fanzania. Users agree to indemnify and hold harmless fanzania, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on fanzania, by such User or through the User's commissions or omissions.
  • Users hereby grant to fanzania and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users' Content for any of the following purposes:
    • displaying Users' Content on fanzania
    • distributing Users' Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it, and/or
    • storing Users' Content in a remote database accessible by end users, for a charge.
    • This license shall apply to the distribution and the storage of Users' Content in any form, medium, or technology.
  • All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on fanzania(s) belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to fanzania.
  • fanzania may contain links to other Internet sites owned and operated by third parties. Users' use of each of those sites is subject to the conditions, if any, posted by the sites. fanzania does not exercise control over any Internet sites apart from fanzania and cannot be held responsible for any content residing in any third-party Internet site. fanzania's inclusion of third-party content or links to third-party Internet sites is not an endorsement by fanzania of such third-party Internet site.
  • Users' correspondence, transactions or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. Users' correspondence, transactions and usage of the services of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services of such third party. User agrees that fanzania will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions with third parties. Any questions, complaints, or claims related to any third party product or service should be directed to the appropriate vendor.
  • fanzania contains content that is created by fanzania as well as content provided by third parties. fanzania does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the fanzania Services provided on fanzania including while participating in any of the contests hosted on fanzania.

All information collected from Users, such as registration and credit card information, is subject to fanzania's Privacy Policy which is available at Privacy Policy. Below are related information to User Data Safety Policy

Personal data means any information about an individual from which that person can be identified. We may collect and use various types of your personal data:

- Registration Data: To access and use some elements of the Services you must create a fanzania account, by providing us with the information which is identified on the relevant registration page: name, email, date of birth, and country. We will also collect a username and password. Please note that some elements of the Services will not be available if you do not provide the required information. We may also ask or allow you to submit other optional information, including your gender, phone number, post code.

- Identity Data: We also ask you to provide identification information when we provide other elements of the Services: name, age, gender and social media handles/ usernames.

- Contact Data: When we want to communicate with you, or you with us, we use your email address, telephone numbers, social media handles/ usernames and location (country/ place of residence).

- Media Data: We use images from photographs and video footage of crowds and fans and other media content created by us (or on our behalf) at fanzania matches and events or provided by you for our use.

- User Data: We collect your usage and preference details related to your use of the Services such as language, game-play statistics, scores, rankings, time spent playing, game profile, preferences (including favourite Clubs), survey responses, feedback and other data that you provide to us as part of your account.

- Marketing and/ or Communications Data: We retain your preferences in receiving marketing messages from us and our Clubs and commercial partners, and your communication preferences.

- Technical Data: Certain data is automatically generated and collected by us when you use the Services such as your IP address, MAC address and other device identifiers; your clickstream to, through and from the Services (including date and time); pages you viewed or searched for; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs); methods used to browse away from the page.

Not all of the list above will necessarily apply to you - it depends on your use of the Services and your particular interaction and communications with us. Please refer to 4. HOW AND WHY WE USE YOUR PERSONAL DATA below.

You provide us with your personal data when you:

  • - access, use or play the Services;
  • - create a fanzania account for the Services;
  • - request information, marketing and other communications to be sent to you;
  • - enter a competition, promotion or survey;
  • - complete surveys or provide us with your feedback; and
  • - otherwise interact or correspond with us (including via email, social media or telephone).

In connection with some elements of the Services we also receive additional personal data about you from other organisations who have collected personal data from you, such as our member league clubs (IPL teams), other Cricket organizations (such as the CA or BCCIA) and our commercial partners (like XX) and data collected on our behalf at fanzania events. We may also receive personal data as part of the legal processes we undertake to protect our Services and our intellectual property, such as our brand or media rights, or those of our licensees/commercial partners.

We collect the Technical Data automatically as you interact with our Services by using cookies and other similar web technologies. Please refer to our Cookie Policy for more information.

We also use third party tools to help us manage and analyse our social media presence, and report on comments, mentions and other content that is posted about us on social media sites and other public channels and forums. These third parties’ activities, and their information collection and sharing practices, are subject to the terms of the relevant social media site, channel or forum. We will use this information in accordance with this Privacy Policy.

We use a third party service, Google Analytics, to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to certain parts of the Services. This information is only used by us in a way which does not identify you. We do not make, and do not allow Google to make, any attempt to find out the identities of anyone visiting our website.

We will only use your personal data where Data Protection Law allows us to. Data Protection Law says we can collect and use personal data on the following bases:

  • it is necessary for us to be able to perform an agreement with you.
  • it is necessary for our legitimate interests (and your interests and fundamental rights do not override those interests);
  • if we have your consent (which you can withdraw at any time); or
  • to comply with a legal obligation e. rules laid down by courts, statute or regulation.

Accordingly, we lawfully use your personal data in the following ways:

Delivering the Services: We use the Registration Data, User Data and Communications Data so that we can deliver the Services to you in an effective, efficient and accurate way. Without it we would not be able to deliver a tailored service to you or respond to issues with these Services that are identified by us or you, or ensure you get the most out of your experience. Therefore, we use this data on the basis that it is necessary for us to be able to perform our agreement with you (i.e. the terms and conditions of the relevant Services) and for our legitimate interests of delivering the Services in this way.

Operating the Services: We use the Technical Data in order to operate and administer the Services including as necessary for testing, analysis, maintenance, support, reporting and hosting of data. Therefore we use this data on the basis that it is necessary for our legitimate interests of operating the Services in this way. We also use Technical Data together with certain Identity Data and Contact Data to assist in security and fraud prevention, system integrity (such as preventing hacking, cheats and spam) and/ or to facilitate our response to a legal process. Therefore we use this data on the basis that it is necessary both for our legitimate interests in protecting the Services in this way and in order that we can comply with a legal obligation.

Competitions and promotions: We use Identity Data and Contact Data and any other personal data related to the entry (for example, a photograph) in order that we can administer contests, prize draws or other promotions including selecting the winners, delivering the prizes and publishing the results (as required by UK advertising regulations). Therefore, we use this data on the basis that it is necessary for us to be able to perform our agreement with you (i.e. the terms and conditions of the relevant promotion) and in order that we can comply with a legal obligation. If we want to use the personal data for any other purpose we will notify you and, if necessary, seek your consent at that time.

Marketing communications: We use the Identity Data and Contact Data to inform you of news, offers, events, competitions and promotions by specified media (including, if requested, by way of calendar notifications) which may be of interest to you and/ or we provide such data to our Clubs and/ or our official commercial partners so that they can do this. We give you the option of providing opt-in consent to receive different kinds of direct marketing communications from us or these third parties or deciding not to do so.

OPT-ING OUT: You can withdraw your consent and opt-out of marketing communications from us at any time by updating your Email Preferences (where you have signed up to our website) or by following the instructions provided to you in the relevant communication (for example, the 'unsubscribe' link in an email). Alternatively, you may contact us at info@fanzania.com. We may still need to send service emails to you from time to time.

If you have chosen to receive communications directly from a particular team or commercial partner, you will be consenting to us passing the data to them to use in accordance with their privacy policy, to which we provide links on our website, so you should contact them directly if you no longer wish to receive their communications.

Media coverage: We use the Media Data together with Identity and Contact Data for fanzania-related publishing and media coverage. Except where you are not the subject of the Media Data, for example in general crowd shots, we will seek your consent and provide you with information about our intended use of such information.

Fanzone callers: The fanzania delivers the FanzoneProgramme in conjunction with IMG Studios. We use the Identity Data, Contact Data and Communications Data along with any other information you share with us (for example, which Club you support) when you contact us via your chosen means (a "caller") in connection with our operation, administration and distribution of the Fanzone audio-visual programme. We then keep a record of this information so that we can contact you in the future if we would like to hear from you again or reuse your comments. By providing this information to us you are consenting to our use of the data for these purposes and you can withdraw that consent at any time by contacting us at dataprotection@fanzania.com. Note that we also keep a record of caller details to ensure we don't use the same callers each time and to prevent repeat of abusive callers so we are using this data on the basis that it is necessary for our legitimate interests in providing interesting, inclusive and responsible programming.

fanzania Fan Panel: If you provide your opt-in consent we will use basic Identity and Contact Data to send you links to Fan Panel research surveys to gather opinion from football fans on a range of issues that affect the fanzania and the information submitted is used to help shape the future of the fanzania. These surveys may ask you to submit additional personal data (including age and gender), however, all entries are anonymous.

Other purposes: We could have to use your personal data which we hold to protect your or someone else's vital interests for example to make contact in rare emergency situations. We could also have to use your personal data in connection with legal and regulatory matters such as our maintenance of business records, compliance with external reporting requirements and internal policies and procedures and responses to requests by government, law enforcement, regulators, courts, rights holders or other third parties including in respect of the use or misuse of intellectual property, such as our brand or media rights, or those of our licensees/commercial partners or their parties. Therefore we use this data on the basis that it is necessary both for our legitimate interests in protecting, defending and enforcing rights and interests in this way and also so that we can comply with legal obligations.

We will only use your personal data for the purposes for which we collected it as described above, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

What if you do not want to share your personal data? Unless otherwise specified above, generally we collect your personal data on a voluntary basis. However, please note that if you decline to provide certain mandatory personal data, you may not be able to access certain Services and we may be unable to fully respond to any inquiries you make.

We may disclose or share your personal data in the following circumstances: Third Party Service Providers. We engage third party businesses to provide services to us or to you on our behalf, such as support for the internal operations of our Services (and related services), communications, data storage and delivering communications (including calendar notifications).

In providing their services, they may access, receive, maintain or otherwise use personal data on our behalf. Our service providers only use your personal data in accordance with our strict instructions to provide the relevant services and are not permitted to use your personal data for their own purposes, unless authorised by us to do so. Commercial Partners. We may also disclose your personal data to our commercial partners where you have consented or requested that we do so. For example, when you enter a competition or sweepstake which is a joint promotion, or you request to receive certain marketing communications. You will be given clear information in each case before we disclose share your personal data.

Publicity and media. We may disclose your personal data publicly via the media, social media or on the Services. For example, when sharing a comment or opinion you have provided such as when you contact the Fanzone, or if you win a competition or promotion we may disclose your name online. In such cases, we will clearly notify you of the sharing, and you will have the choice not to participate or to otherwise object to such sharing, subject to our other legal obligations. This Privacy Policy applies to our use of your personal data only, and you should refer to the relevant privacy policy of each relevant Club to understand how they use your personal data. Legally Required. We may also disclose your personal data if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes or in the event of a re-organisation of the legal or ownership structure of the fanzania.

Notwithstanding anything else in this Privacy Policy, we may share aggregate or de-identified information with third parties for research, marketing, analytics and other purposes, provided such information does not identify a particular individual and the individual cannot be re-identified.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed (a Data Security Breach). In addition, we limit access to your personal data to those employees, contractors and other third parties who have a business need to know. They will only use your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected Data Security Breach and will notify you and any applicable regulator where we are legally required to do so.

Where we have given you or you have chosen a password which enables you to access certain Services, you are responsible for using reasonable care in keeping this password confidential.

The Services may contain links to other websites, applications and environments that are not owned or controlled by us (the Other Sites). The owners and operators of those Other Sites are responsible for their collection or use of your personal data and you should check their respective privacy policies. Unless specifically referred to otherwise, this Privacy Policy applies to the Services only and not the Other Sites.

We will only keep your personal data for as long as necessary to fulfil the purposes we collected it for (see 4. WHY WE USE YOUR PERSONAL DATA), including for the purposes of satisfying any accounting, reporting or other legal requirements, in accordance with our Data Retention Policy.

To determine the appropriate retention period, we review - in addition to the purposes of use and how we can achieve them - other relevant factors such as the nature and scope of the personal data, the potential risks to data subjects from a Data Security Breach, and the applicable legal requirements, for example the limitation period for which legal claims can be made in court.

For example, all non-activated fanzania accounts are deleted after 21 days and all non-authorised child accounts are deleted immediately if a parent withholds consent and after 21 days if a child’s account is not verified.

Under Data Protection Law, you have certain rights (depending on the circumstances) in connection with your personal data, which include:

- Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are using it lawfully, provided always that this does not adversely affect the rights and freedoms of other people;

- Request correction of the personal data that we hold about you. Where any of the information we hold about you is incorrect or incomplete we will act promptly to rectify this, including where you have requested us to do so. Users of the fanzania website can update their information any time via their account preferences;

- Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to use it. You also have the right to ask us to delete or remove your personal data where you have exercised your right to object to our use (see below);

- Object to use of your personal data where we are relying on our legitimate interests (see above) and there is something about your particular situation which makes you want to object to our use on this ground;

- Withdraw your consent to our use of your personal data where we do so in reliance on your consent. Once we have received notification that you have withdrawn your consent, we will no longer use your personal data for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law;

- Request the restriction of use of your personal data. This enables you to ask us to suspend the use of personal data about you, for example if you want us to establish its accuracy or the reason for using it; and

- Request the transfer of the personal data you have provided, on the basis of consent or for a contract with us, to you or a third party where technically feasible.

We are committed to respecting your rights. You may action your rights (as may be applicable) by contacting us using the details provided below and we will comply with your requests within a reasonable period unless we have a lawful reason not to do so.

Requests should be made in writing and to ensure that personal data is dealt with carefully and confidentially we will require the requestor to provide verification of their identity and all applications must be accompanied by copies of at least two official documents, which show your name, date of birth and current address (for example, driving licence, birth/ adoption certificate, passport, recent utility bill).

In responding to such requests, we will explain the impact of any objections, restrictions or deletions requested. We will not charge you a fee to exercise your rights unless your request is clearly unfounded or excessive, in which case we may charge you a reasonable fee. Alternatively, we may refuse to comply with the request in such circumstances.

  • Users agree to abide by these Terms and Conditions and all other rules, regulations and terms of use of the Website. In the event User does not abide by these Terms and Conditions and all other rules, regulations and terms of use, fanzania may, at its sole and absolute discretion, take necessary remedial action, including but not limited to:
    • restricting, suspending, or terminating any User's access to all or any part of fanzania Services.
    • deactivating or deleting a User's account and all related information and files on the account. Any amount remaining unused in the User's Game account or Winnings Account on the date of deactivation or deletion shall be transferred to the User's bank account on record with fanzania subject to a processing fee (if any) applicable on such transfers as set out herein; or
    • refraining from awarding any prize(s) to such User.
  • Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by fanzania). Users further agree to update and keep updated their registration information.
  • A User shall not register or operate more than one User account with fanzania.
  • Users agree to ensure that they can receive all communication from fanzania by marking e-mails or sending SMSs from fanzania as part of their "safe senders" list. fanzania shall not be held liable if any e-mail/SMS remains unread by a User as a result of such e-mail getting delivered to the User's junk or spam folder.
  • Any password issued by fanzania to a User may not be revealed to anyone else. Users may not use anyone else's password. Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify fanzania of any unauthorized use of their passwords or accounts or any other breach of security.
  • Users agree to exit/log-out of their accounts at the end of each session. fanzania shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.
  • Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorised third party software designed to modify or interfere with fanzania Services and/or fanzania experience or assist in such activity.
  • Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying fanzania or fanzania Services.
  • Users agree that without fanzania's express written consent, they shall not modify or cause to be modified any files or software that are part of fanzania's Services.
  • Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support fanzania or the fanzania Services (each a "Server"); or (2) the enjoyment of fanzania Services by any other User or person.
  • Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt fanzania Services or any other person's use or enjoyment of fanzania Services.
  • Users shall not attempt to gain unauthorised access to the User accounts, Servers or networks connected to fanzania Services by any means other than the User interface provided by fanzania, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of fanzania Services.
  • Without limiting the foregoing, Users agree not to use fanzania for any of the following:
    • To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication;
    • To harass, stalk, threaten, or otherwise violate any legal rights of other individuals;
    • To publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content;
    • To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, fanzania, any software, hardware, or telecommunications equipment;
    • To advertise, offer or sell any goods or services for any commercial purpose on fanzania without the express written consent of fanzania;
    • To Transmit content regarding services, products, surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters;
    • To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner;
    • To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material;
    • To restrict or inhibit any other user from using and enjoying any public area within our sites;
    • To collect or store personal information about other Users;
    • To interfere with or disrupt fanzania, servers, or networks;
    • To impersonate any person or entity, including, but not limited to, a representative of fanzania, or falsely state or otherwise misrepresent User's affiliation with a person or entity;
    • To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through fanzania or to manipulate User's presence on fanzania(s);
    • To take any action that imposes an unreasonably or disproportionately large load on our infrastructure;
    • To engage in any illegal activities. You agree to use our bulletin board services, chat areas, news groups, forums, communities and/or message or communication facilities (collectively, the "Forums") only to send and receive messages and material that are proper and related to that particular Forum.
  • If a User chooses a username that, in fanzania's considered opinion is obscene, indecent, abusive or that might subject fanzania to public disparagement or scorn, fanzania reserves the right, without prior notice to the User, to change such username and intimate the User or delete such username and posts from fanzania, deny such User access to fanzania, or any combination of these options.
  • Unauthorized access to fanzania is a breach of these Terms and Conditions, and a violation of the law. Users agree not to access fanzania by any means other than through the interface that is provided by fanzania for use in accessing fanzania. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.
  • Use of fanzania is subject to existing laws and legal processes. Nothing contained in these Terms and Conditions shall limit fanzania's right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of fanzania.

    • Persons below the age of eighteen (18) years are not allowed to participate on any of the contests, games (by whatever name called) on the fanzania Platform. The Users will have to disclose their real age at the time of getting access into the fanzania Platform.
  • fanzania may not be held responsible for any content contributed by Users on the fanzania.
  • In order to register for the Contest(s), Participants are required to accurately provide the following information:
    • Full Name
    • Team Name(s)
    • E-mail address
    • Password
    • State of Residence
    • Gender
    • Datef birth
  • Participants are also required to confirm that they have read, and shall abide by, these Terms and Conditions.
  • Once the Participants have entered the above information, and clicked on the "register" tab, and such Participants are above the age of 18 years, they are sent an email confirming their registration and containing their login information.
  • The courts of competent jurisdiction at Bangalore shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the fanzania Services provided by fanzania (including the Contest(s)), the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) (including Participants) or fanzania, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.
  • In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.
  • The place of arbitration shall be Bangalore, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
  • The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.
  • Nothing contained in these Terms and Conditions shall prevent fanzania from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard fanzania's interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of fanzania to pursue any remedy for monetary damages through the arbitration described herein.
  • Users shall access the fanzania Services provided on fanzania voluntarily and at their own risk. fanzania shall, under no circumstances be held responsible or liable on account of any loss or damage sustained (including but not limited to any accident, injury, death, loss of property) by Users or any other person or entity during the course of access to the fanzania Services (including participation in the Contest(s)) or as a result of acceptance of any prize.
  • By entering the contests and accessing the fanzania Services provided therein, Users hereby release from and agree to indemnify fanzania, and/ or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access to the fanzania Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
  • fanzania accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the prizes.
  • Users shall be solely responsible for any consequences which may arise due to their access of fanzania Services by conducting an illegal act or due to non-conformity with these Terms and Conditions and other rules and regulations in relation to fanzania Services, including provision of incorrect address or other personal details. Users also undertake to indemnify fanzania and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by fanzania on account of such act on the part of the Users.
  • Users shall indemnify, defend, and hold fanzania harmless from any third party/entity/organization claims arising from or related to such User's engagement with the fanzania or participation in any Contest
  • To the extent permitted under law, neither fanzania nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.
  • To the extent permitted under law, fanzania shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, games, products, fanzania services or sites, cancellation of competition and prizes. fanzania disclaims any responsibility for, and if a User pays for access to one of fanzania's Services the User will not be entitled to a refund as a result of, any inaccessibility that is caused by fanzania's maintenance on the servers or the technology that underlies our sites, failures of fanzania's service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control. In addition, fanzania does not provide any warranty as to the content on the fanzania(s). fanzania(s) content is distributed on an "as is, as available" basis.

  • Any material accessed, downloaded or otherwise obtained through fanzania is done at the User's discretion, competence, acceptance and risk, and the User will be solely responsible for any potential damage to User's computer system or loss of data that results from a User's download of any such material.
  • fanzania shall make best endeavours to ensure that the fanzania(s) is error-free and secure, however, neither fanzania nor any of its partners, licensors or associates makes any warranty that:
    • the fanzania(s) will meet Users' requirements,
    • fanzania(s) will be uninterrupted, timely, secure, or error free
    • the results that may be obtained from the use of fanzania(s) will be accurate or reliable; and
    • the quality of any products, fanzania Services, information, or other material that Users purchase or obtain through fanzaniacom(s) will meet Users' expectations.
  • In case fanzania discovers any error, including any error in the determination of Winners or in the transfer of amounts to a User's account, fanzania reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit, including through a set-off of the erroneous payment from amounts due to the User or deduction from the User's account of the amount of erroneous payment. In case of exercise of remedies in accordance with this clause, fanzania agrees to notify the User of the error and of the exercise of the remedy(ies) to rectify the same.
  • To the extent permitted under law, neither fanzania nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if we have been advised of the possibility of such damages.
  • fanzania may be required under certain legislations, to notify User(s) of certain events. User(s) hereby acknowledge and consent that such notices will be effective upon fanzania posting them on the fanzania or delivering them to the User through the email address provided by the User at the time of registration. User(s) may update their email address by logging into their account on the fanzania. If they do not provide fanzania with accurate information, fanzania cannot be held liable for failure to notify the User.
  • fanzania shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to any failure to perform due to unforeseen circumstances or cause beyond fanzania's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials or any cancellation of any cricket match.
  • fanzania's failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
  • Users agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the fanzania or these Terms must be filed within thirty (30) days of such claim or cause of action arising or be forever barred.
  • These Terms and Conditions, including all terms, conditions, and policies that are incorporated herein by reference, constitute the entire agreement between the User(s) and Yorker Games LLP and govern your use of the fanzania, superseding any prior agreements that any User may have with Yorker LLC.
  • If any part of these Terms and Conditions is determined to be indefinite, invalid, or otherwise unenforceable, the rest of these Terms and Conditions shall continue in full force.
  • fanzania reserves the right to moderate, restrict or ban the use of the fanzania, specifically to any User, or generally, in accordance with fanzania's policy/policies from time to time, at its sole and absolute discretion and without any notice.
  • fanzania may, at its sole and absolute discretion, permanently close or temporarily suspend any fanzania Services.
    fanzania maintains a transparent refund policy to help our loyal Users. Our guidelines for refund policy has been outlined below:

  • A Subscription fee once paid is final and no cancellation is permissible.

  • fanzania may, in certain exceptional circumstances and at its sole and absolute discretion, refund the amount to the User after deducting applicable cancellation charges and taxes.

  • fanzania reserves the right to cancel or change any premium features or services without giving any prior notice or reason.

  • The User acknowledges that any transactions done on the fanzania platform may take up to 24-48 hours to be processed due to the time taken for bank reconciliations and other such external third party dependencies.

  • Any amount paid or transferred into the User's Wallet may take up to 24-48 hours to reflect in the User’s wallet account balance.

  • Any money debited from User’s Wallet may take up to 24-48 hours to reflect in the User's wallet account balance.

  • Users agree not to raise any complaint or claim against fanzania in respect of any delay, including any lost opportunity to join any Match Contest or Tournament Match due to a delay in any credit to the User wallet (whever applicable).
